By using thermometerchart.net (the "Service") you agree to these Terms of Service. If you do not agree, do not use the Service.
thermometerchart.net lets you create embeddable fundraising thermometer charts. Charts are delivered as image files that you embed on your own website using an <img> tag. The Service is available as a free tier (with watermark) and a Pro tier (paid, watermark-free, with additional chart styles and features).
The free tier is available without an account or payment. Free charts display a "thermometerchart.net" watermark baked into the image. You may use free charts for any lawful purpose, including commercial campaigns, provided you comply with the acceptable use rules below.
The Pro tier is purchased as an annual license for a single domain via Gumroad. On purchase, Gumroad issues a license key by email. You enter that key when creating a thermometer to unlock Pro features.

We reserve the right to disable any chart that violates these rules without notice.
You retain ownership of the data you enter (chart titles, goal amounts, etc.). By submitting it, you grant thermometerchart.net a limited license to store and render it solely for the purpose of providing the Service. We do not claim any rights over your content beyond what is needed to operate the Service.
We aim for high availability but do not guarantee uninterrupted service. Embedded charts may be temporarily unavailable during maintenance or outages. We are not liable for any impact on your fundraising campaign caused by chart downtime.
The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Service will meet your requirements, that it will be error-free, or that defects will be corrected.
To the maximum extent permitted by applicable law, thermometerchart.net and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost donations or fundraising shortfalls. Our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid for your current license period, or $10 USD if you have not paid anything.
We may modify the Service or these Terms at any time. Material changes will be noted with a revised effective date. Continued use of the Service after a change constitutes acceptance of the updated Terms. If you disagree with a change, your remedy is to stop using the Service.
These Terms are governed by the laws of the jurisdiction in which the operator is located, without regard to its conflict of law provisions.
